Resolved Question: I don’t know what to do?
My town has a leash law.A couple times my dog has broken her leash and got off and the police came and told us that we had to keep her on one.Well we finally got a leash and collar that she can’t get off of.Well There is this little girl that lives up the road. She is a brat.Hits my daughters and her mom does not supervise her at all(she is 7).3 days ago I told her she was not aloud at our house anymore.Today we were gone almost all day.Well we came home and my neighbors came out and said they were just getting back from the lake and inside and heared a blood curdling scream and looked out and it was the little girls running from our house. They figured she had got bitten by our dog.Well the next thing they knew there was 5 cops at our house and they were holding tazers trying to get out dog out from under our porch(on her leash). The little girl I guess was taken by ambulance to the hospital. So my husband went to the police station and they could not tell us anything that happened other than a child had been bitten, and that our dog was being quarantined for 10 days and we got a vicious dog citation.Well we were looking outside and they took her chain, collar and all. They won’t let us see our dog until Monday.Mind you that our dog has NEVER been aggressive toward children. We have 4 and the little girl used to come to our house all the time and even show up at 9pm and walk up to the door with the dog licking her.(our dog is an Austalian Shepherd.) so not even a big dog.My MIL and FIL went up to talk to the police and to get the collar and leash and I guess the little girl had a small puncture wound.Well while we were standing outside waiting for them to get back the little girl rides her bike down to our house(we live on a dead end street with like 5 houses on it)Its dark out and nobody once again is even out there. We called and got a family lawyer tonight and will discuss stuff with him next week.I think they will probably try to sue us.Missouri from what I have read is a “one bite” state meaning usually your not liable if its the first time your dog has bitten and you have no reason to think that your dog would attack somebody. The thing is we were following the law by having our dog on the leash and we were not home which was clear(our vehicle was gone). She should not have been at our door anyway.1) we were not home 2) she was told not to be at our house.I am sooo mad right now.Im mad that our family pet is gone and my little girls are so upset and keep asking where Lucy is and why she is gone. They have been crying since we got home.Anyone else have anything similar happen?Am I right that she was tresspassing. We didn’t invite her on the property,my dog was not running loose(I was abbiding the leash law) and we were not even home.
oh and at the end of our walk there was a huge pile of blood MIL asked about it and they said the dog catcher cut her mouth open capturing her but my neighbors say they(cops) were screaming, taking pictures, holding tazers at her and kicking her trying to get her from under the porch.
she is the front yard.We have a covered front porch and she wont go in her dog house so we keep her up there so she can get on the porch when its raining etc.Plus 3 nights ago we caught someone trying to break into our truck so we are glad she was up there. She is very territorial(that breed it) and barks when people are messing around to warn us
no and acutally I am thinking about reporting the mom to DFS.She has her 13 year old son superivise the girl all the time. One Time my daughter was hit by a stick by the girl and was bleeding screaming in front of their house(I was in my house feeding my 5 month old twins)and the mom didn’t even come out to see what was wrong I heared it and walked 3 houses down and got on to the girl and brought my 4 year old home.It doesn’t make since that the girl can come to my door at night with us home to see if my girls can play and I tell her they are in bed(its 9pm) and she doesn’t get bitten.I bet anything the dog jumped on her to say hi and she took off running or hit the dog,The little girls shoe was still in our yard.
for her being so hurt they took her by ambulance it was kinda funny the little girl was out riding her bike.We did take a picture of that.I do let my children play outside but they always ask if they can go to her house and I know where they are.Her mom don’t half time time. The thing is they just moved in and bought their house like a month ago and seems like they have been nothing but trouble since. And from what us and my neighbors have said they aren’t very welcome.Everyone is upset about the dog.I guess my neighbors gave the cops a mouthful.Should I go talk to the mother and ask what happened and explain that I have told the little girl NOT to come to our house and that we were not even home all day?
we walk her everyday and let her run in the back yard for a few hours in the morning and evening with us out there everyday(we just can’t keep her in the backyard because she jumps the fence if we aren’t out there)I feel bad chaining her but she does get lots of attention. She is like another child

Voting Question: How do I file a defamation/slander suit and what do I ask for?
I have been having trouble over the past few years from one of my neighbors. Long story – I bought my home in a small lake community in rural Missouri 6 years ago. I am a hispanic single mom with 2 kids from Dallas Texas, we are the only non-white family in the community. When we moved we also brought along our new born pit bull puppy. Over the years we have lived here, this one neighbor has been harassing us by calling the cops on anything he can possibly think of most of which was nothing at all (grass was over 5 inches tall in places, my RV was blocking his view of the lake – from 2 houses away, I had too many cars in my driveway – my bf is a mechanic) now things are getting worse, last year someone tried to break into my house and left the sliding glass door open and my pit (indoor dog) got out (probably what scared the burglar away) so he jumped at the chance to call the police claiming vicious and aggressive animals were running the streets, this got my pit of 5yrs at the time shot, luckily she lived – and NO she is not mean in any way. Recently my new roommate let the dogs out in the back yard to get some sun so he called the cops because my dogs were loose in my own backyard (he said he was scared to mow his grass) they took them in and now they want to put them to sleep because it has become a problem. NOW this guy is going around telling the neighbors that I’m running a drug house. He even went as far as to tell a friend parked in my drive way that he was writing down all the cars license plate numbers and the times they arrive and leave so he can turn us in as a drug house, so I called the cops on him. They went to him and threatened to take him to jail if he stepped on my property again, so his new move is to go door to door to neighbor’s houses trying to get them to sign some petition stating that they think im running a drug house too, some have signed just based on his word. I dont know what to do anymore, I was told I could file a civil suit but I don’t know how or what to ask for. Can anyone help? This is getting ridiculous!
To the responder about the “dogs” and “cars” our puppy grew up and yes we did take in a 3 legged stray about 2 years ago so we had 2 dogs. We do have several cars, a truck, a van, & an rv, a car trailer, & the kids have 4 wheelers (this IS rural missouri & a lake property). But 4 adults & 2 children (myself, my 2 fem roomies and ones bf, & my 2 kids) live here, I drive 70 miles back & forth to work so I also have a backup vehicle, they are older cars (80’s and 90’s) that need work from time to time. They are all tagged, insured, & legal…. what I really need to know is what kind of lawyer handles this type of suit & second what am I asking for? I just want him to quit harassing my family & friends & to quit trying to get all my neighbors to hate me, if he would just take back what he said about us I would feel better. As it stands now, if my coworkers hear this(I work as an accountant at a school) & schoolmates(I also go to school full time) it could jepordize my integrity at work.

Short Sale or Foreclosure

A lot of folk go thru bank foreclosures nowadays. According to professionals, more than twenty p.c of Americans are in default of the mortgage payments and are candidates for bank foreclosure. If you be one of those people who are on the verge of losing your home due to bank foreclosure, you mustn’t give up easily and just let the bank take your property without exhausting all possible options to save your house. To help you save your house from bank foreclosure, these are some things that you can do.

Foreclosure is a ugly thing and you stand to lose a large amount of things when your home gets foreclosed. To avoid foreclosure, you may need to sell your home. Selling your house may seem painful to you but when things really get rough, it’s much better to sell your house and earn some cash out of the sale than let the bank foreclose your property. To get the most out of the sale of your house, learn how much is the current market value of your house. If you home is located in a prime location, its worth might have increased significantly during the past few years.

To get a fair assessment of the market value of your home, interview some real estate agents. You could also hire the services of a professional broker to sell your home. The best thing about hiring a pro broker to sell your home is that you will no longer have to go to all the difficulties of finding a buyer and then doing the bureaucracy once the buyer decides to buy your home. What is the catch? The catch here is you need to pay a commission to the broker after the sale of the home. However, considering the sort of service that you get from the broker, it’s only fitting that you compensate your broker well. Remember that there’s no such thing as free service these days.

The home market is in a bad shape and many properties across the country are worth significantly less than their original cost. If your property has been badly affected by the housing crisis, you will have to sell your home for a little lower price. Yes, a short sale isn’t terribly appealing but compared to foreclosure, a short sale is better. To stop foreclosure and still be in a position to get a fair price on your property, you want to put your property up on sale as soon as possible.

Banks are not truly pleased with the idea of foreclosing so many properties. Remember that banks are into the money business not the estate business. Since the bank has equity over your property, the bank party owns your home. Foreclosure of bank owned properties is therefore bad business for them. Banks want their clients to continue paying their amortization and as long as their clients are prepared to pay their monthly amortization, banks are open to talks. If you want to stop bank foreclosure, you should never pay no attention to the collection letters from your bank. A lot of bank repossessions occur after the customer ignore a pair of collection letters from the bank. Instead of ignoring the collection letters sent to you by your bank, you need to take some time to respond to these letters and barter for further honeymoon period. You may also visit your bank and talk to the loans of officer personally. Tell the loans officer that you are prepared to pay your dues to stop bank foreclosure but you want a tiny time to get the money for this reason.

When dealing with your bank, you want to outline your plans on how you are going to pay for your finance needs. You may also submit a financial plan to the bank. Your money plan needn’t be complicated. All you want to do is to show the bank where you’ll get the money to pay for your monthly amortization.

FHA StreamLine Refinance

FHA has permitted streamline refis on insured home mortgages since the early 1980’s. The “streamline” relates only to the sum of certification and underwriting that asks to be executed by the loaner, and does not mean that there are no tolls involved in the dealing. The basic necessities of a streamline refi are:

The mortgage to be refi must already be FHA insured.

The house loan to be refinanced should be current (not delinquent).

The refi is to result in a taking down of the borrower’s annual principal and interest payments.

No cash may be made out on home mortgage refinanced using the streamline refi action.

Lenders may offer streamline refinances in several ways. Some loaners provide “no cost” home refinance (actually, no out-of-pocket expenses to the borrower) by charging a higher rate of interest on the new loan than if the borrower financed or paid the closing costs in cash. From this premium, the lender pays any closing costs that are incurred on the home refinance.

Lenders may provide streamline refinances and take on the closing costs into the new mortgage total. This can simply be done if there is decent equity in the place, as seen by an appraisal. Streamline home refinance can also be done without estimates, but the different loan number cannot exceed the original loan sum. Investment properties (properties in which the borrower does not lodge in in as his or her key residence) may only be home refinance without an assessment.

Before you even get started with your FHA streamline, nature that you’re so someone who understands the FHA market and can get it done right.

Maintenance Fees and Costs for First Time Home Buyers

When you’re considering what type of home to purchase as a first time home buyer, understanding the total maintenance costs may be a key factor in your decision making process.

Each specific type of home has unique maintenance costs attached to them. These could range from government and local taxes to community association fees. If you are a first time homebuyer, take the time to know the maintenance costs for each house you are interested in; as this can spare you from future headaches. Below is a list of the common maintenance fees for each type of houses.

Condominiums: An increasingly popular choice for first-time homebuyers, living in a condo means you have access to shared living spaces and amenities. As a result, you’ll be responsible for paying association fees and maintenance fees that are based on a percentage of ownership of the building.

Ilyce Glink, author of the book ‘100 Questions Every First-Time Home Buyer Should Ask’ explains that condo fees are calculated by taking the total building’s expense and dividing that by the percentage of ownership. The total building expenses include the building’s emergency reserve account, and the final cost may fluctuate over the course of the year.

Townhomes: Townhomes, also known as ‘row houses’, are independently owned homes that typically don’t incur fees beyond your regular expenses. However, some townhomes are part of a homeowner’s association, in which case you will need to pay a monthly fee for maintenance. This fee typically covers the cost of painting the exterior and landscaping common areas.

Mobile Homes and Pre-Fabricated Homes: Mobile home owners and pre-fabricated homeowners are usually responsible for all fees involved with maintaining and operating their home. This includes the cost of sewage, water, cable and other utilities. However, some mobile home sites do charge additional fees for renting the land, and every park has its own rules, regulations and requirements.

Single-Family House: Detached home maintenance costs are typically the responsibility of the homeowner. Even if the home is within a community setting, the homeowner will be responsible for maintenance and upkeep, landscaping, lawn services and other fees associated with maintaining a home. You will also be responsible for all real estate taxes and government fees; check with the Realtor and a financial advisor to get an estimate on what this may be.

Ascertain the total maintenance costs from a Realtor first before approaching any loan company or officer. Lenders may at times include maintenance fees and other costs in your loan package. Give all the information you got from your Realtor to your loan officer and inform him/her of your budget to acquire a loan that will fit your needs.

Whether you’re interested in a town home or a single-family house, there will be several costs involved with home ownership and maintenance. When you’re searching for the right fit, consider making a checklist or worksheet that lists all of the different home options and related fees. Having a side-by-side comparison of the total costs involved can help you make the most informed decision for your new home purchase.

Americans are Opting Out of the Housing Market

I saw on MSNBC the other day that a recent poll by Realtor.com revealed that more than half of those parties interested in purchasing a new home are not ready to pull the trigger and buy yet. Their biggest concern was that they would lose their job and be unable to support the new home. Other fears potential homebuyers expressed in the poll was that they were bothered by falling home prices and worried that they would be unable to sell the home they were currently living for enough money.

I have also noticed this reluctance among my customers, and while restrictive credit is prohibiting some possible buyers from taking action, even those folks who could easily get a mortgage loan are concerned that prices will continue to decline. Furthermore, as many of the best deals in the marketplace are foreclosed properties, new homebuyers are constantly reminded that purchasing a home is a big risk financially in these troubling times. And a lot of consumers believe that buying a foreclosed property is much more complicated than a straight purchase.

The Realtor.com poll additionally reported that people are largely doubtful that the Governments plan to stop the foreclosure crisis by injecting $50 billion in incentives into the lending industry will be successful. Less than one third of the surveyed individuals thought it would do the trick.

What does all this really mean, though? What I am seeing is that at least in the short-term, renting continues to grow as an attractive option for both many homeowners and potential homebuyers.

Renting gives those relocating an option to test out the market and find the right fit, and allows those needing to upgrade a chance to do so much sooner than they might be able to in these current conditions. Potential sellers are choosing to rent instead of sell, as well, in order to allow the real estate market to recover and their values to rise. Until there is a real shift in the market and consumer confidence, renting will continue to be an attractive option for many would be purchasers.

Using A Real Estate Agent Is A Smart Choice

If you are having trouble figuring out how to sell a house, you might consider using a real estate agent. Having a real estate agent help you sell your house is great for every reason except the commission you have to pay her/him. That commission is the number one reason why many people try to sell their houses by themselves. Saving money is great but unless you have sold a house before, you might run into lots of trouble your first time.

When you set out to sell your house, you will quickly become aware that there is a lot of work involved. Not only do you have to do everything to fix up the house and get it ready to be shown and sold, but you need to be able to stay on top of all the paper work as well. Using an agent is a good idea because they will take care of all the legalities and forms that every homeowner must fill out and file. Also, you will sleep better knowing that there is a solid real estate company behind you that will take care of any unforeseen problems.

If you are a first time house seller, you may be a bit overwhelmed by all the legal paperwork that needs to be taken care of. Forms have to be filled out with the city and with the banks as well. This might not be a great time to be learning all of this by yourself and you might do better having a real estate agent show you how it is done. If you can learn the first time from an agent, perhaps your second house you sell in the future will be a better one to try to sell yourself without help.

Another reason to use a real estate agent is that they have methods of getting your house seen by as many people as possible. In todays economy, it is important to get your house listed in all the for sale databases and to spread awareness about your house. This is the job of a real estate agent and they can most certainly do it better than you can. You might in the end be able to sell your house yourself but you may be able to sell it a lot quicker with the aid of a competent real estate agent.

Right now there is a buyers market and you will have to do all the things you can think of to get your house sold. Advertising and holding open houses to get as many people in to see it is a good start but in the end it might only be the price that matters. Buyers are so strapped for cash right now and they know they are in the drivers seat. If you dont lower your house enough, there might be nothing you can do to sell it. Whether you use an agent or not, if you have the price too high you will probably have a lot of difficulty making the sale.

Why It’s A Must to Have a Picture Of Finished Basement

For example you bought a new house that has a spacious basement. You want to use it but do not have a clue just yet on what you could have it for. At this point, you are thinking of a plan.

Visualize – Like all plans, first thing that comes to mind is to imagine of what you want your basement to look like. However you want to use it, it pays to have a picture of finished basement in your head. Why is it so? Here are some of the reasons why it is important to do this.

- This is a project you can’t afford to fail. It is essentially part of the process. Yes it is. Any architect or interior designer will tell you that before any project will start, a design plan should be made. There must be an advanced perspective of what you want your basement to look like. If you succeed in this phase of having a picture of finished basement in your mind, then you are on the right track.

- Illustrations are a big help. As mentioned in the first pointer, you must have a clear picture ahead of your basement?s look. In doing this, it is required that you translate your idea into a perceptive sketch. You may draw it yourself or have someone with a talent in drawing do it for you. It doesn?t have to be in scale for now. The picture of finished basement should just be comprehensive and clear enough for those who might also help you build it.

- Details are important. In drawing a plan of your basement, consider it highly. Accuracy in details is always an advantage and is necessary at this point. This is where you draw the plan to scale. This is where you start expanding your idea. The detailed perspective sketch of your basement can better lead you into drawing other details for the plan and will help you later on. Details in your picture of finished basement should be able to guide you in construction. And this is true especially when something falters in the process, you could always refer to the detailed plan.

- Know what to expect. The picture of finished basement that you drew guides you to your expectations. Starting from the sketch, you move your ideas backwards. Then you build it back up from there. It may be assumed that you do not know much about carpentry, construction materials, tools, and the steps in building your basement. But if your perspective is clear, it should be able to get your details planned out too. Of course, you cannot do this unless you have finalized and outlined your concept. Even if you just did it first in your head.

The possibilities are endless. You can use it as your home office. You can use it as a mini gym. Some households convert their basement into a mini bar for friends to party and hangout. And you probably had this figured out from the first day you bought the house.

Whatever you hope to use for it, it is up to you. Just always remember to take into serious consider to have a clear picture of finished basement before you decide what to do with it.
